Tiger Text Messaging Sweepstakes Official Rules
ELIGIBILITY: NO PURCHASE NECESSARY TO ENTER OR WIN. Sweepstakes (the "Sweepstakes") is open to legal residents of the fifty (50) United States and D.C. (excluding residents of Rhode Island), who are eighteen (18) years or older at the time of entry (if the age of majority in the jurisdiction where you live is over 18, you must be of the age of majority in your jurisdiction). Employees, officers, and directors (including immediate family members and members of the same household) of MLB Advanced Media, L.P. ("MLBAM"), the other MLB Entities, ETW Corp. ("ETW") and each of their respective affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers and advertising and promotion agencies, and any and all other companies associated with the Sweepstakes are not eligible to participate. The "MLB Entities" shall mean MLBAM, the Office of the Commissioner of Baseball, its Bureaus, Committees, Subcommittees and Councils, SportsOnEarth, LLC, Tickets.com, Inc., Major League Baseball Enterprises, Inc., Major League Baseball Properties, Inc. (doing business in its own name and as Major League Baseball Productions), the Major League Baseball Clubs, and each of their subsidiaries or affiliated entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Major League Baseball Clubs or the Office of the Commissioner of Baseball, and the directors, officers and employees of the above entities. The Sweepstakes is subject to all applicable federal, state, local laws and regulations. Void where prohibited or restricted by law.
HOW TO ENTER: The Sweepstakes begins at 12:01 p.m. Eastern Time ("ET") on April 3, 2007 and ends at 11:59 a.m. ET on April 8, 2006 ("Entry Period"). There are two ways to enter: by mobile phone, or by mail. No other method of entry will be accepted. Limit one entry per person regardless of method of entry.
- Mobile Method: To enter using a 2-way text messaging enabled and activated mobile phone ("Mobile Phone"), during the Entry Period, send the text message from your Mobile Phone to the 55222 with the word "TIGER". Upon MLBAM's receipt of your text message, you will receive one (1) entry into the Sweepstakes. Check your Mobile Phone's capabilities for specific instructions. Standard text messaging rates apply-check with your carrier for details.
- Mail-in Method: If you do not wish to enter online using a Mobile Phone, you may enter the Sweepstakes by printing your name, address, city, state and zip code, day & evening telephone number, date of birth and email address (optional) on a standard size postcard and mail to: Tiger Text Messaging Sweepstakes, c/o MLB Advanced Media, L.P., 75 Ninth Ave., 5th Floor, New York, NY 10019, Attn: Sweepstakes Department. MLBAM will only use email addresses provided via the Mail-in entry method for prize notification purposes only; however, eligibility to participate in the Sweepstakes is not dependent upon entrant's provision of this information. Mail-in entries must be postmarked by April 8, 2007 and received by MLBAM by April 15, 2007. Mail-in entries become the property of MLBAM and will not be returned.
RANDOM DRAWING: The winner of the Sweepstakes (the "Winner") will be selected by random drawing to be conducted by MLBAM on or about April 17, 2007 from all eligible entries received by MLBAM, whose decisions, including the selection of winners, are final and binding on all matters relating to this Sweepstakes. Odds of winning depend on the total number of eligible entries received. All prizes will be awarded. Limit one prize per person, family or household.
PRIZES: ONE (1) PRIZE WILL BE AWARDED. The Winner will receive a Masters Pin Flag autographed by Tiger Woods (the "Prize"). (Estimated Retail Value of Prize: $ 2,000)
The Winner is fully responsible for any and all applicable federal, state, international and local taxes. All costs and expenses not specified herein, related to the Prize, including expenses incurred by accepting the Prize are the sole responsibility of the Winner. The Prize is non-transferable and non-assignable, with no cash redemptions except at MLBAM's sole discretion. There will be no substitutions for the Prize except due to unavailability, in which case, a cash prize of equal value to the face value of the Prize will be awarded at the exclusive discretion of MLBAM.
NOTIFICATION: The Winner will be notified by e-mail and/or telephone by MLBAM and may (in MLBAM's discretion) be confirmed by postal mail, return receipt (the "Prize Notification"). In the event that the Winner does not respond to such Prize Notification within three (3) days, a disqualification will result and an alternate winner shall be chosen from among all remaining eligible entries. The Winner will receive MLBAM's Affidavit of Eligibility and Release of Liability, which must be completed, notarized and returned within ten (10) days of receipt. A disqualification will result and an alternative winner will be randomly selected from among all remaining eligible entries if MLBAM's Affidavit of Eligibility and Release of Liability are not properly returned within the specified period of time. Refusal or return of MLBAM's Affidavit of Eligibility and Release of Liability as non-deliverable will also result in disqualification and cause an alternative winner to be chosen from among all remaining eligible entries.
WAIVER OF LIABILITY/PUBLICITY RELEASE: By participating in the Sweepstakes and submitting an entry, all entrants agree to be bound by these Official Rules, including all entry requirements. By entering the Sweepstakes, each Winner agrees to waive any and all claims against the MLB Entities, ETW and each of their respective parents, affiliates, subsidiaries, officers, directors, employees, agents, licensees, distributors, dealers, retailers, printers, representatives and advertising and promotion agencies (collectively, the "Released Parties") for any injury, damage or loss that may occur from the participation in the Sweepstakes or from the receipt or use of any prize or travel related to the receipt or use of any prize. Participants agree to allow MLBAM, ETW and their designees to use their names and likenesses in any and all mediums now or hereafter known for advertising and publicity purposes throughout the world in perpetuity, without any compensation, notification or permission, unless prohibited by law.
GENERAL CONDITIONS: The Released Parties are not responsible for printing or typographical errors in any Sweepstakes-related materials; stolen, late or misdirected entries, lost, damaged, garbled, delayed, misdirected, damaged, incomplete, postage due or illegible entries. Sweepstakes entries generated by a script, macro or other mechanical or automated means will be disqualified. The Released Parties are not responsible for incorrect, inaccurate transcription or loss or delay of entry or prize reply information, technical, hardware, software, telephone or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions or other errors of any kind, whether human, mechanical or electronic, which may occur in the processing of the entries or distribution of prizes in this Sweepstakes or which may which may limit one's ability to enter the Sweepstakes, including any injury or damage to participant's or any other person's handset, related to or resulting from participating in this Sweepstakes. If, in the exclusive judgment of MLBAM, this promotion becomes compromised in any way, MLBAM reserves the right to withdraw the promotion offer, cancel any method of entry, to void any entries submitted fraudulently or select winners from all eligible entries received prior to act that compromised the promotion.
Any attempt to deliberately damage the content or operation of this Sweepstakes is unlawful and subject to legal action by the Released Parties. MLBAM shall have the sole right to disqualify any contestant for violation of these Official Rules or any applicable laws relating to the Sweepstakes, and to resolve all disputes in their sole discretion. The Released Parties (i) make no warranty, guaranty or representation of any kind concerning any prize, and (ii) disclaim any implied warranty. All disputes will be resolved under applicable U.S. laws in the County of New York, state of New York.
MLBAM reserves the right, in its sole discretion, to cancel or suspend the Sweepstakes should virus, bugs, unauthorized human intervention, or other causes beyond the control of the Released Parties corrupt administration, security, fairness, integrity or proper operation of the Sweepstakes. In the event of cancellation, MLBAM may elect to identify winners and award the prizes by way of random drawing from among all entrants who had entered the Sweepstakes at the time of such cancellations.
Any text message form of entry into this Sweepstakes will be deemed made by the named account holder whose mobile phone number is assigned to the Mobile Phone used at the time of entry.
WINNERS' LIST: For a list of winners, mail a self-addressed stamped envelope to: Tiger Text Messaging Sweepstakes Winners List, c/o MLBAM, 75 Ninth Ave., 5th Floor, New York, NY 10019. Winner's list requests must be made by May 31, 2007.
